If you’re getting married in New York City, the legal requirements are straightforward.
But they are also exact.
Most issues don’t come from complexity—they come from missing one step or misunderstanding timing.
This guide is the clean version of what’s actually required.
Before anything else, both parties must meet basic legal criteria:
Be 18 years or older
Not currently married to someone else
Not closely related (as defined by New York law)
That’s the foundation.
If those conditions are met, you can proceed.
You cannot legally marry in NYC without a marriage license.
This is issued by the New York City Clerk.
To obtain it:
both parties must apply together
present valid government-issued ID
provide basic personal information
The license is issued after your appointment is completed.
Once your marriage license is issued, you must wait at least 24 hours before your ceremony.
There are rare judicial waivers—but you should not rely on them.
Plan for the full 24-hour period.
Your marriage license does not last indefinitely.
You must complete your ceremony within 60 days of issuance.
If it expires, you must reapply and pay the fee again.
The person performing your ceremony must be legally authorized in New York City.
This includes:
judges
clergy members
registered officiants
If you are hiring an independent officiant, confirm they are registered with NYC.
This is not optional.
At least one witness is required for your ceremony.
They must:
be present during the ceremony
sign the marriage license afterward
There is no requirement for multiple witnesses or a large group.
There is no required script.
But legally, the ceremony must include:
a clear declaration of intent
both parties agreeing to marry each other
This can be done in simple language.
The law does not require anything elaborate.
After the ceremony:
the officiant signs the license
the witness signs the license
The officiant is responsible for returning the completed license to the City Clerk.
Once processed, your marriage becomes official in the system.
This is where many people overcomplicate things.
You do not need:
a venue
a large guest list
a formal ceremony structure
a wedding planner
Those are optional.
The legal requirements are minimal.
A few things consistently cause problems:
Trying to skip the 24-hour waiting period
This will invalidate the ceremony.
Letting the license expire
You must stay within the 60-day window.
Using an unregistered officiant
This can delay or invalidate your marriage filing.
Forgetting a witness
The ceremony cannot be completed legally without one.
